Vida Midwifery LLC SMS Privacy Policy, Terms and Conditions
As of Feb 3, 2025, new consumer protection regulations require formal agreement for text messaging communications through our current SMS business carrier (Grasshopper). The privacy information, terms and conditions of use follows.
Vida Midwifery LLC (“Vida Midwifery”) offers communication by SMS/text message as a service provided to clients who have agreed to this mode of communication. Your use of this service constitutes your consent to the terms and conditions of this service listed here. This service may include SMS/text message responses to inquiries that are received via SMS/text message from an individual (i.e. requests for more information about our services, or to change a scheduled appointment). You may also receive SMS/text messages from Vida Midwifery if this was discussed and consented to directly with a provider for matters brought up during a consultation or care appointment (i.e. contact information for community resources, or links to further educational resources). You may receive information directly related to your care only if you have consented to such communication via the HIPAA consent document in your portal.
Data Collection: We will collect your name, email address, mobile phone number, and date of birth when you sign up for SMS text communication. This information is collected via the website contact form, email, or a phone conversation, depending on how you contact Vida Midwifery.
Data Usage: We use your data solely for sending updates and reminders related to our services and events as a practice.
Data Security: We protect your data with secure storage measures to prevent unauthorized access.
Data Retention: We retain your information as long as you are subscribed to our SMS communications. You may request deletion at any time.
MESSAGE AND DATA RATES MAY APPLY. Your mobile carrier may charge fees for sending or receiving text messages, especially if you do not have an unlimited texting or data plan.
Message frequency may vary. Users may receive messages as needed based on their interactions with our practice. We do not utilize SMS for mass messaging or marketing campaigns, and so messaging frequency is tied directly to your care/prospective care and the frequency with which you contact us via SMS with a response requested or indicated, or to confirm receipt of a SMS/text message that you have sent.
You may contact our office for help regarding any concerns with text message communications by calling: (575) 628-8330, or by emailing us at hello@vidamidwifery.com, or through the messaging feature on your client portal. This includes a request to stop receiving communication via SMS at any time. You may text STOP to (575)628-8330 to stop receiving text messages from our practice. You will receive a final SMS/text to confirm you have unsubscribed and we will remove your number from our list within 24 hours.

Vida Midwifery does not collect or use any personal information transmitted via text message, except as appropriate and indicated for the direct administration of your healthcare. For example, we will collect your name and telephone number if you schedule a consultation via SMS/text message so that your appointment can be added to our calendar; or, if, as an active client, you send information regarding your current health status, this may be entered into your electronic health record as appropriate. Vida Midwifery will never share your information without signed, written consent via the HIPAA Privacy Agreement, which can be found in your client portal under Forms and Records > Consent Documents. Vida Midwifery will never sell your information to a third party under any circumstance.
Your privacy rights and communications options are outlined in the HIPAA Privacy Policy document found in your client portal under Forms and Records > Consent Documents. You may update this form at any time by notifying a provider with our practice of your desire to do so.
